General:

The general terms and conditions apply to the sale and delivery of goods as well as to services and offers. Deviating conditions of the client / buyer are only valid if we have agreed in writing. With the submission of your order you agree to these terms and conditions.

Copyright:

The production and reproduction of all templates and files provided to us is subject to the condition that you have the right to reproduce and indemnify and hold us harmless in this respect against the copyright holder. You shall be solely liable if the execution of your order infringes any rights, in particular the copyrights of third parties. You shall unconditionally indemnify us from all claims of third parties due to such an infringement.

 Original documents and print carriers:

For originals, or other items that are not picked up by you within four weeks, we assume no liability. For original documents that were handed over to us for binding, we can also assume no liability. We do not assume any liability for print carriers that you bring with you, neither for the durability of the print nor for the print carriers.

Offers:

Cost estimates and offers are subject to change and non-binding. All offers are valid for one month, unless otherwise agreed. The prices shown in our quotations or on our website are subject to the proviso that the order data on which the quotation is based remain unchanged (in particular, this refers to the number of color or b/w copies and the number of embossing lines). We cannot guarantee the correctness and completeness of price information given by telephone.

Conclusion of contract:

Our offers or the presentation of the products on our website are subject to change and therefore do not represent a legally binding offer, but only a non-binding online catalog. We reserve the right to make technical and other changes. Your orders on our website, however, are binding offers for the conclusion of a purchase contract for the services and goods offered by us.

The confirmation of the receipt of your order will be sent immediately after sending your order. This confirmation of receipt informs you that we have received your order and that the purchase contract has been concluded.

Prices and charging:For our services and goods, the current price list at the time of contract conclusion applies, unless you receive a corresponding offer at the time of contract conclusion. We pack your books carefully, and charge a one-time fee of 3,- EUR. Basically, cash payment at pickup is agreed. In exceptional cases or in case of shipment, payment can be made on account. You are liable for the payment of the placed orders in any case, even if they have to be charged to third parties. In case of late payment we charge you 12% interest on arrears and for reminders 20,- EUR/reminder.

Ownership:

We retain ownership of the delivered goods until full payment of the purchase price.

Delivery time:

The delivery time begins on the day of order receipt, as soon as all necessary documents are available, or after print approval and is usually 24 - 48 hours. Cancellation by the client before the start of production is possible without costs. Claims for damages due to delayed delivery are only possible in case of intent or gross negligence.

Delivery, shipping:

Delivery is made personally by us or by mail or courier service. Postage and packaging costs will be charged according to our current price list.

Complaints:

You are obligated to check the sample prints or files received for correction for correctness and to notify us immediately of any complaints. With the release for printing, the risk of any errors is transferred to you. The same applies to all other release declarations for further production. Notifications of defects must be made and specified immediately, at the latest within one week after receipt of the goods. In case of justified notice of defects and in case of lack of warranted characteristics, we can carry out subsequent improvements or make a replacement delivery. Further claims of the customer, in particular a claim for compensation of damages which have not occurred to the delivery item itself, are excluded. Color deviations in color copies, color prints and binding materials are possible. In principle, we do not accept any liability for minor color deviations between sample print and production. Minor deviations in format and color do not entitle the customer to make a complaint.

Right of withdrawal/cancellation policy:

Withdrawal from the contract according to the Consumer Protection Act (KSchG)

The Austrian Consumer Protection Act stipulates that withdrawal from the contract on the part of the customer is excluded if the customer initiated the contract himself (§3.3.1), as well as for goods manufactured according to customer specifications that are clearly tailored to personal needs (§5f.3). Therefore, a withdrawal from the contract according to KSchG is excluded for thesis binding and photo book products.

Applicable law and place of jurisdiction:

Austrian law shall apply. The exclusive place of jurisdiction is Vienna.

Severability clause:

Should individual provisions of the contract with you, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.
